Terms & Conditions — Echoes of the Earth

1. Purpose
These Terms and Conditions govern the relationship between Echoes of the Earth, an eco-responsible travel agency, and any individual making a purchase via the website www.echoesoftheearth.odoo.com or through direct agreement.
They apply to all services offered, including downloadable digital products (e.g., PDF guides) and custom-designed travel planning services.
By purchasing any service or product, the client expressly waives their own terms and conditions. Any exceptions must be agreed upon in writing and in advance by Echoes of the Earth.
2. Digital Products (PDF Guides)
All guides are delivered automatically by email after payment is confirmed.
These products are considered instantly delivered and are therefore non-refundable and non-exchangeable, in accordance with Article L221-28 of the French Consumer Code concerning digital content.
By completing the purchase, the client expressly waives their right of withdrawal.
It is the client’s responsibility to carefully review the product type before completing the payment.
3. Custom Travel Design
Echoes of the Earth offers tailor-made travel experiences, created in collaboration with carefully selected local partners. Each project begins after full payment of a custom planning fee.
a. What the planning fee includes:
- A personalized briefing (via form, call, or email)
- Research and design of the itinerary, flights, accommodations, transportation, and activities
- A detailed and realistic proposal, aligned with the traveler’s wishes
- A detailed quote and a custom-designed PDF travel guide
The planning fee is non-refundable, even if the trip is not confirmed.
If the client proceeds with the trip, the planning fee will be deducted from the final price.
b. Modifications after quote validation
After the quote has been validated and paid, the client may submit requests for small changes.
However, no guarantee can be given regarding the feasibility of these adjustments, especially if bookings with partners have already been initiated.
Any request involving major changes may incur additional fees or require a new quote.
4. Bookings & Responsibility
Echoes of the Earth acts as an intermediary for bookings (accommodation, transportation, activities…), working with trusted local partners. The agency cannot be held responsible for:
- Changes, delays, cancellations, or issues caused by third-party providers
- Unexpected weather conditions, strikes, or force majeure
- Unclear or unstated expectations from the client
- The traveler’s failure to comply with local laws or requirements (visas, vaccinations, etc.)
5. No Obligation of Result
Echoes of the Earth is committed to delivering a high-quality service, within agreed timeframes. However, the agency is bound by an obligation of means, not an obligation of result.
We cannot guarantee that the client’s experience will match personal expectations that were not clearly communicated beforehand.
6. Travel Insurance
No insurance (cancellation, health, baggage, repatriation) is included in any of the services provided.
It is the client’s responsibility to arrange appropriate travel insurance before departure.
Echoes of the Earth will not cover any costs or assist with issues related to illness, delays, lost items, or accidents before, during, or after the trip.
7. Personal Data
Client data collected during orders or communications is used exclusively to manage the client relationship.
Data is never shared or sold to third parties. Clients may request to access, update, or delete their personal information at any time.
8. Intellectual Property
All content created by Echoes of the Earth (texts, images, documents, PDF guides) is protected by copyright.
It may not be copied, modified, shared, or used commercially without written permission.
9. Complaints
Once a service is delivered (digital guide or custom travel itinerary), it is considered final.
Echoes of the Earth cannot be held liable for any dissatisfaction expressed after the quote has been validated or the product has been delivered, as long as it matches the agreed content.
No complaint will result in a refund, modification, or compensation — except in the case of a proven error by the agency.
10. Governing Law
These terms and conditions are governed by the laws of the country where the seller is based. In case of dispute, a peaceful resolution will be sought first.
Failing that, the appropriate courts will have jurisdiction.
